1. Terms and conditions of use

1.1. The website www.gestramvia.it (hereinafter “Site”) is the exclusive property of GEST S.p.A., with registered office in Scandicci (FI), Via dell’Unità d’Italia, 10, (hereinafter “GEST”).
1.2. Access to and browsing the website by individual users is free and subject to acceptance of the terms and conditions of this legal notice.
1.3. The user acknowledges and in any case agrees:

• (i) that GEST reserves the right to modify the terms and conditions of the legal notice at any time by communicating the changes to users through a general notice posted on the site, or through a link to such notice;
• (ii) that, from the moment of each general notice mentioned above, the legal notices as amended will constitute the new terms and conditions to which access to, and navigation on the site will be subject to these legal notices, as gradually modified (hereinafter the “Legal Notice”).

2. Intellectual Property Rights

2.1. The contents of the site, such as, but not limited to, works, images, photographs, dialogues, music, sounds, videos, texts and any other material in any format, including, by way of example but not limited to, menus, web pages, graphics, colours, patterns, tools, fonts, design, diagrams, layouts, methods, processes, functions and software (individually and/or collectively “Contents”) and the related distinctive signs and/or logos are the exclusive property of GEST or anyhow in its exclusive availability, and in any case they cannot be used in any way and/or form without the prior written consent by GEST.
2.2. Any use of the Contents in violation of the limits indicated in the Legal Notice, or in any case contrary to the law, is illegal and therefore will be punishable by GEST.
2.3. The GEST trademarks and logos, including the domain name gestramvia.it, are in the exclusive availability of GEST. These trademarks, logos and domains cannot be used in any way without the prior written consent by GEST.

3. Links to other websites

3.1. The Site may contain text links (the “links”) to other websites that have no connection with the site. GEST does not control or monitor such websites, their contents and their rules.
3.2. Any link to other websites must not be understood in any way as an activity by GEST to promote them and/or the content published on them.
3.3. Visiting and using the sites consulted by the user from this site via links, therefore, is left exclusively to the total discretion and responsibility of the user.
3.4. These legal notes, therefore, refer only to the GEST site and the services offered therein, and not to other websites that may be consulted by the user via links.

4. Cookies

4.1. In compliance with the Guidelines for Cookies and other tracking tools of the Data Protection Authority, of June 10th 2021 (Published in the Official Gazette No. 163 of July 9th 2021), the site may contain “session cookies” (which are not stored permanently on the user’s computer and disappear when the browser is closed) with the aim of allowing users a better usability of the Site.
Users who prefer not to receive cookies can set their browser with the intention of being warned of the presence of cookies and then decide whether to accept them or not. The browser can also be set to automatically reject all cookies; in this case, however, the user may not be able to access all the services available on the site. On the Site there are Matomo Analytics, which allow you to examine the traffic on the Site, without violating the privacy of users and in full compliance with European privacy standards. 5. Data processing – Privacy

5.1. GEST, as data controller, guarantees that the data received via e-mail and/or through electronic registration forms, are treated in compliance with the provisions of the current legislation on Privacy (GDPR n. 2016/679).
5.2. In order to access some services provided through this site, it may be required to fill in some forms containing personal data (such as, by way of example: name, surname, e-mail address). Any request for services by the user (such as the request for information and/or the request for complaints) involves the acquisition of the related data by GEST, which is necessary for the provision of the aforementioned services.
5.3. GEST Privacy Policy is available on the website and further specific information may be published on the site pages set up for particular services on request. The content of the above information may be updated on the basis of subsequent regulatory interventions on privacy and/or the modification of the purposes for which the data will be processed. Any substantial modification will be promptly communicated by the controller to users, through the publication of the updated text on the site.

6. Limitation of Liability

6.1. The user acknowledges and in any case agrees that his access to and navigation of the site is entirely at his own risk and under his sole responsibility.
6.2. The user also acknowledges and in any case agrees that the site is provided “as is” and “as available” and that it may be temporarily inaccessible or otherwise contain defects or be delayed.
6.3. GEST takes no responsibility for content, materials and/or information posted on the site by users in the special virtual spaces that GEST makes available to users themselves for interaction with the site (“User Content/s”).
6.4. GEST will not be liable for any loss or damage deriving from or in any way related to the use or operation of the site, including – without limitation to – damages for loss of business, loss of profits, interruption of business, loss of commercial information and/or any other type of pecuniary loss, except in cases of wilful misconduct or gross negligence by GEST.
6.5. GEST does not guarantee that the site is free of errors or viruses. GEST and its suppliers are not responsible for any damage suffered by the user due to such harmful agents.

7. Reporting abuse

7.1. Users who have identified any User Content that they consider illegal, inappropriate, offensive or vulgar are invited to promptly report it to GEST, via e-mail at the following address: info@gestramvia.it.
7.2. The user is encouraged to make responsible use of their reports. Any reports or notifications that prove to be unfounded and/or illegitimate will be a source of responsibility at their expense.

8.1. The Legal Notices are regulated by Italian law.
